Legitimate Interest of the Employer

A ruling in late 2012 found that activities undertaken by employees on Workers' Compensation in their day to day life are of legitimate interest to employers.

From OHS Alert:  “As an occasion where a claim for payment is being made and as an employee is claiming to be suffering from an inability to attend for duty, the activities engaged in by an employee otherwise rostered-on, on a work day, during their rostered hours, falls entirely within a category of legitimate interest of the employer”.
